GENERAL PURCHASE CONDITIONS

INTRODUCTION

This contractual document establishes the terms and conditions for purchasing products through the 3 Claveles website, owned by BUENO HERMANOS, S.A.

Please read these General Terms and Conditions of Purchase and our Privacy and Cookie Policy carefully before using this website. By using this website or placing an order through it, you agree to be bound by these Terms and Conditions and our Privacy and Cookie Policy. Therefore, if you do not agree with all of the Terms and Conditions and the Privacy and Cookie Policy, you should not use this website.

Acceptance of this document implies that the buyer:

Has read, understood, and comprehended the terms herein.

Is over 18 years of age with the legal capacity to enter into contracts.

Agrees to all the obligations set forth herein.

Orders may only be placed for the purchase of goods for personal use and not for resale. Any resale or distribution of products purchased through the website is strictly prohibited.

We reserve the right to cancel fraudulent, false, or speculative orders, as well as orders placed by customers with whom we have had previous disputes or disagreements, or when we have reasonable grounds to believe that the customer is violating any of the specified purchase conditions or is involved in criminal activity.

These conditions will remain in effect indefinitely and will apply to all purchases made through the Bueno Hermanos, S.A. website.

Bueno Hermanos, S.A. reserves the right to unilaterally modify these conditions, without affecting goods or promotions purchased prior to the modification.

CONTRACTING PARTIES

On the one hand, BUENO HERMANOS S.A., with Tax Identification Number (NIF) A26004614, located at P. I. Cantabria I, C/ Barrigüelo, 6, 26009 Logroño (La Rioja), Spain, and email address info@buenohermanos.com.

And on the other hand, the buyer, registered on the 3 Claveles website with a username and password, for which they are fully responsible for use and safekeeping.

The buyer is obligated to provide Bueno Hermanos, S.A. with all the necessary information for accessing and using the services of this website. This information must be truthful and up-to-date, and the buyer consents to our use of it to contact them if necessary.

It is essential that you provide all the information marked as mandatory, as we will not be able to process your order if you do not. We will not be responsible in any case for possible delays or failures in delivery as a result of the error or omission of this data.

  1. SUBJECT OF THE PURCHASE CONDITIONS

These purchase conditions are intended to regulate the purchase by the buyer of any of the products offered by Bueno Hermanos on its website 3 Claveles according to the conditions published at the time of purchase.

  1. TERMS AND CONDITIONS APPLICABLE TO ORDERS

The products offered through this website are only available for delivery to mainland Spain and the Balearic Islands.

If you wish to place an order from another country through this website, you may do so; however, please note that we only offer delivery to addresses within Spain, excluding the Canary Islands, Ceuta, and Melilla.

4.1 HOW TO PLACE AN ORDER

To place an order, you can browse the website until you find the desired product. Once located, clicking on it will give you access to all the detailed information the website offers. From there, you can add the product to your cart.

If this is your first time shopping with us, you will be asked to register by entering your email address and a password to create and access your account.

If you already have an active account, simply enter your email and password, and the system will recognize your information.

From your account, you can continue shopping and finally confirm your order.

Once you accept the terms and conditions and place your order, it will be considered accepted. You will then receive an email acknowledging receipt of your order, and the contract between you and us will be formalized at the time of order placement.

Orders will be shipped Monday through Friday. Orders placed over the weekend will be processed the next business day.

If you would like to receive an invoice, please request it when placing your order.

4.2 PRODUCT AVAILABILITY

All orders are subject to product availability. If there are any difficulties in supplying products or if items are out of stock, we will inform you as soon as possible by email or telephone, and we will refund any amount you may have paid.

4.3 ORDER DATA, CONFIRMATION AND CANCELLATION

If you notice an error in your personal information during registration on this website, you can correct it in the "My Account" section.

Before finalizing your order on the website, you can review all the details and make any necessary corrections.

Once the order is confirmed, it will not be possible to modify or cancel it through the website. You must contact us. In such cases, the order can only be canceled if the item has not yet been shipped from our warehouse.

4.4 PRICE AND PAYMENT

Prices on this website are shown in euros and include VAT at the rate applicable in Spain, excluding the Canary Islands, Ceuta, and Melilla. Shipping costs are not included and will be added to the total amount. The applicable VAT rate will be the legally established rate at the time of purchase.

Bueno Hermanos, S.A. only ships to Spain (excluding the Canary Islands, Ceuta, and Melilla).

Orders will only be processed once payment has been completed and verified.

Payment must be made by credit card (VISA and MASTERCARD) or PayPal.

Credit card payments are processed through a payment gateway (Virtual POS): the buyer's information and purchase details will be entered and transmitted directly by the buyer to the payment gateway provider. This information will not be stored or processed by us; it will be registered directly with the payment gateway of the corresponding financial institution. The order amount will be charged to your card. You will need to provide the card number, expiration date, and the CW2 security code (on the back of your card). If your card is secured, you will be asked for the relevant security codes. Alternatively, you can pay for your order through the bank's payment gateway.

The charge will be processed in real time through this payment gateway. If the charge cannot be completed (for any reason), the order will be automatically canceled.

PayPal: You must be a registered PayPal user. To complete the payment, you will be asked to log in to your PayPal account, either to pay with your credit card or with your PayPal balance.

4.5 DISCOUNT CODES

Promotional codes may be offered from time to time.

The terms and conditions for any discount code will be specified at the time of issue. However, these terms and conditions apply to all our company's promotions, contests, and discount codes (unless otherwise stated):

- Only one promotional code may be used per order.

- A promotional code cannot be used after an order has been placed.

4.6 ORDER DELIVERY

Bueno Hermanos, S.A. only ships to Spain (excluding the Canary Islands, Ceuta, and Melilla). Orders will be shipped Monday through Friday via Correos Express during normal business hours.

Shipping is free for orders over €50 (VAT included).

For orders under €50, shipping costs are €7 for mainland Spain and €15 for the Balearic Islands.

Delivery times are calculated based on business days (Monday through Friday), as the courier company does not deliver on Saturdays, Sundays, or public holidays.

The usual delivery time is approximately 48 hours for mainland Spain and 72 hours for the Balearic Islands. This timeframe may be longer during sales periods, Christmas campaigns, or due to other circumstances such as geographical distance, weather conditions, war, strikes, any form of government intervention, supplier delays, etc. as well as any other issues attributable to the logistics operator responsible for delivering the product. We are not responsible for any delays that may arise for any of the reasons mentioned above.

If the order packaging is damaged upon delivery, you must open the package in the presence of the delivery driver to verify the condition of the items. If any damage is observed, you must detail it on the delivery note and contact us within 24 hours. We will repair or replace, at no cost to you, any items that have been damaged or lost during transport, provided that you notify us of the incident as soon as possible.

Once the order has been delivered, it becomes your property, and therefore, any damage that may occur will be your responsibility.

4.7 RETURNS POLICY

 

4.7.1 Right of Withdrawal

 

You may exercise your right to withdraw from this contract within 14 calendar days without giving any reason, provided that the item shows no signs of use and is in its original packaging.

The withdrawal period will expire 14 calendar days from the day on which you, or a third party indicated by you other than the carrier, received the goods.

To exercise your right of withdrawal with respect to products purchased exclusively from 3 Claveles, you must notify us by means of an unequivocal statement, which you must send to us by one of the following means:

- By mail to the address BUENO HERMANOS, S.A. P. I. Cantabria I, C/ Barrigüelo, 6 26009 Logroño (La Rioja), Spain.

- By email to info@buenohermanos.com.

You may use the model withdrawal form attached to these Terms and Conditions, although its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of this right before the withdrawal period has expired.

4.7.2 Consequences of Withdrawal

If you exercise your right of withdrawal, we will reimburse the buyer for all payments received after the purchase, including delivery costs (excluding any additional costs arising therefrom), without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of your decision to withdraw.

We may withhold reimbursement until we have received the goods back or until the customer has provided proof of return.

Refunds will be issued using the same payment method used for the purchase, and you will not incur any fees as a result of the refund, except for the return shipping costs.

The goods must be returned in the same condition as when they were delivered, with all original packaging and containers.

For a product to be accepted for return under the right of withdrawal, it must be properly protected, in its original packaging, in perfect condition for resale, and with its labels intact.

Shipping costs for returns are non-refundable and are the responsibility of the buyer.

4.7.3 Returns

If you receive your order damaged during transport, it is important that you take photographs of the packaging and the damage to support a possible claim with the shipping company. You must also note this on the delivery slip that you sign for the delivery driver. You have 24 hours to report this issue. If you receive the package and no damage is visible because the box was sealed, you also have 24 hours to report the damage.

If you receive a damaged or defective item, please take photos and contact our Customer Service department to request a replacement.

If you receive the wrong product, you have 7 calendar days to file a claim.

All return shipping costs are the responsibility of Bueno Hermanos, S.A., provided the reason for the return is attributable to the company. This applies to any manufacturing defects, warehouse errors, or damage incurred during shipping.

4.7.4 Warranty

 

Please note that if you are purchasing as a consumer, we offer warranties on the products we sell through this website, in accordance with the legally established terms for each product, against any defects in materials or workmanship under normal conditions of use that become apparent within three years of delivery. This warranty does not cover defects caused by normal wear and tear or misuse of the product.

 

4.7.5 Dispute Resolution

 

In compliance with Article 14.1 of Regulation 524/2013 on online dispute resolution, we inform you that you can access the Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/

  1. APPLICABLE LAW AND JURISDICTION

The relationship between Bueno Hermanos, S.A. and the buyer will be governed by Spanish law.

Any dispute arising from or related to the use of or purchase through this website will be subject to the non-exclusive jurisdiction of the Spanish courts.

When the purchase is made as a consumer, nothing in this clause will affect the rights recognized by current legislation.

In cases where the buyer is not a consumer or user, or is domiciled outside of Spain, the courts of Logroño will have jurisdiction, expressly waiving any other jurisdiction that may apply.
